1. Agreement

By accessing or using our website, documentation, APIs, or related services (the “Services”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. The Services

DataGen provides tools to design and generate synthetic tabular and structured sample data for testing, demos, training, and related lawful purposes. Features may include a web application, HTTP API, optional MCP integration, and documentation. We may modify, suspend, or discontinue features with reasonable notice where practicable.

3. Eligibility and accounts

You must have legal capacity to contract in your jurisdiction. Where API keys, organisation enablement, or paid tiers apply, you are responsible for safeguarding credentials and for all activity under your keys or accounts.

4. Acceptable use

You agree not to misuse the Services. Without limitation, you must not: violate law; infringe third-party rights; attempt to gain unauthorised access; probe or scan systems except as part of good-faith coordinated disclosure we approve; overload or disrupt infrastructure; resell or redistribute the Services in breach of your plan; or use outputs to deceive, defraud, harass, or impersonate real individuals.

Do not use the Services to generate or facilitate unlawful discrimination, harassment, malware distribution, credential stuffing, or other harmful activity.

5. Synthetic data and your responsibilities

Outputs are artificial and may resemble real-world patterns. You are responsible for how you use outputs, including compliance with privacy, marketing, financial, healthcare, or sector-specific rules. Do not represent synthetic data as real sourced data unless clearly labelled and lawful in context.

6. AI-assisted features

Where the Services use AI or heuristics to infer schemas or values, outputs may be incomplete or unsuitable for regulated production use without your own validation. You remain responsible for verifying fitness for purpose.

7. Intellectual property

We retain rights in the Services, branding, and software. Subject to these Terms and your plan, we grant you a limited, non-exclusive, non-transferable licence to use the Services. Unless otherwise agreed, we do not claim ownership of schemas or synthetic datasets you create—but you must have rights to any seed content you supply.

8. Third-party services

The Services may interoperate with third-party tools (for example analytics, hosting, or model providers). Their terms govern your use of those products.

9. Disclaimers

To the maximum extent permitted by law, the Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.

10. Limitation of liability

To the maximum extent permitted by law, neither we nor our suppliers will be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our aggregate liability arising out of these Terms or the Services will not exceed the greater of (a) the fees you paid us for the Services in the three months before the claim or (b) fifty US dollars (USD 50) if no fees applied.

Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent still permitted.

11. Indemnity

You will defend and indemnify us against third-party claims arising from your use of the Services, your content, or your breach of these Terms, except to the extent caused by our wilful misconduct.

12. Suspension and termination

We may suspend or terminate access for breach of these Terms, risk to security or others, or legal requirements. You may stop using the Services at any time. Provisions that by nature should survive (including Sections 7–11) survive termination.

13. Governing law and disputes

Unless a separate written agreement specifies otherwise, these Terms are governed by the laws indicated in your commercial contract, or—if none—the laws of the United Arab Emirates, without regard to conflict-of-law rules. Courts in that jurisdiction have exclusive venue, except where mandatory consumer protections require otherwise.

14. Changes

We may update these Terms. We will post the revised version and update the “Last updated” date. Continued use after changes become effective constitutes acceptance. Material adverse changes to paid customers will be handled as described in the applicable order form or policy.
